In common terms and in the eyes of society, violence is the way of behaviour for his wife which includes mental and physical torture. But violence is not only that. The actual meaning of violence is, if any husband tries to control over the behaviour of spouse or even trying to molest or yells comes under domestic violence.
According to the research of one of the most leading institute of India 4 out of 5 women face any kind of domestic violence from her spouse. Abusing and mental torture is a common and most repeating behaviour of husband which they give the name of anger, mental problems, tension of house and office liabilities, their love for their spouse and other very weird reasons
The domestic violence against any of the partner in the marriage include any kind of spouse abuse, intimate partner abuse, domestic abuse, physical actions like ranging, pinching, pushing, slapping, hitting, choking to death, shooting stabbing and murder. Some of the mental abuse includes verbal, emotional, thinking, psychological abuse by using such kinds of words that are used to demean the partner respect, criticize or demotivates, decrease the confidence of the spouse.
Sexual abuse is the worst from all of them. It means being intimate with the partner with the mutual consent or making physical relationship without the permission of other.
Now one more kind of abuse that is economical abuse, economical abuse means when husbands restricts the financial or economic freedom of wife.
Domestic violence is a very major problem in the Indian society. It not only increases the wife’s mental problems and tension but also results to physical and emotional injuries with lead to death.
When we hear about domestic violence, the first thing that a crime in the mind of society is domestic violence against women but this image is not true. In today’s context not only women but also men are facing the problem of demotic violence.
In Indian society men are always found to be more aggressive and strong. But every coin has two phases. Same in this situation, men are also facing this problem just like women.
Most of the situations domestic violence don’t come into light due to the respect, honour, guilty and society fear because in these incidents society says that he had done something to deserve it. But this is not true.
It is not important that only a man can be aggressive and short tempered sometimes short temperedness of women also lead to these kinds of situations.
These are the numerous types of actions that can be find in domestic violence against men:
Insulting, suffering from name calling, other abusive languages
Interfering in the matters if having with family and friends
Threatening anyone to expose without any reason on front of family and leaking personal information
Being operative in behaviours showing jealousy and possessiveness.
Trying to control the financing and personal expenses of him.
Threatning by harming him or doing something to “punish” him.
It is very difficult to find out the total number of cases of domestic violence as most of the cases go unreported.
One of the biggest reasons of not reporting the domestic violence cases is the Indian social and cultural values. In India women are always teach to be a obedient wife which can do anything for husband, closed her mouth in front of others, never tries to give her opinion and very important tolerate everything that her husband do with her, no matter it is domestic violence or marital rape
While in the context of men, society always expect form them to be aggressive, dominating, and order giving person. So if a man is facing such type of condition then he is not a perfect example of man in society.
It is also seen in the society that even when men are facing domestic violence and when they call the police they actually end up by arresting themselves. It is a kind of fear in the minds of men that no one is going to understand and believe in the problems they are actually facing.
This problem cannot be ended till that this misconception cleared from the society. Society also has to believe that it is not important that the men are the abuser and women are the Vitim, sometimes the situations goes vice-versa.
If these things can be changed then men can also feel easy and comfortable to report the conditions of domestic violence.
Section 498A
Section 498A says, “If any women if any woman is subjected to cruelty by her husband and in laws, and is of such a nature, that it may cause injury to life, limb or health (whether mental or physical) shall be punished with imprisonment for 3 years and shall also be liable to fine.” Act is only for married women.
Domestic violence act, 2005-
This act is not only for married women but for all. For examples, widows, divorce women, single mothers, single women etc.
For men-
There is no fixed act for domestic violence but if anyone who is facing such kind of situation can meet the lawyer or a family attorney to find out the best possible solution for this.
In most of the cases the newly married brides are targeted for the dowry because not only new brides are soft targets but threatening them and hurting them are much easier than others.
Grooms family mainly uses threatening policies and sometimes it extends to physical and mental violence towards the newly married wife which is not just physical but also a mental trauma for her.
Sometimes the conditions of brides get to the worst situations which lead to physical, mental and verbal abuse, emotional torture and family humiliation and more to murder of newly married in less than 1 year of marriage.
Sometimes threatening to bride by husband and new families lead to mental trauma and sometimes to suicide too. There are several of cases come in existence on daily basis of suicide of newly married brides.
Section 498-A of Indian penal court refers to, “ cruelty by husband or relative of husband which includes that whoever being the husband or relative of husband of women, subjects such women to cruelty shall be punished with the imprisonment for a term which may extend to three years and may liable to fine or both.
Punishment given under section 498-A to the husband or the family or relatives of husband as per need may be extend to the period of maximum period of three years but it is a non boilable offence, which makes the possibility of bail for the criminal or his family mostly impossible or rare.
There is a provision of anticipatory bail in the code of criminal procedure section 438. So according to this criminal can apply for the anticipatory bail if caught in the guilty of dowry harassment.
For the cancellation of bail the state or government can apply for it. It is not possible that the bail cancelled automatically. The anticipatory bail for the victim can only be given by the district court or district court. The bail of the person cannot be cancelled by the police itself without any order of the court.
The period of anticipatory bail is for 30 days no longer than that. But after the completion of period of 30 days, the person has to apply for the regular bail which is not possible in this case.
